CLARITY Act: Changes in the Digital Asset Landscape

The Digital Asset Market Clarity Act (CLARITY Act) is designed to establish a clear federal regulatory framework for digital assets and cryptocurrencies in the United States. Passed in the House of Representatives on July 17, 2025 with a bipartisan margin of 294-134, the bill reached the Senate Legislative Calendar on June 1, 2026. It is unknown whether Senate will vote on the CLARITY Act before its recess in August.

The CLARITY Act is intended to establish clear regulatory oversight for Cryptocurrencies and other digital assets. The CLARITY Act distinguishes between types of digital assets. It also establishes a statutory framework for determining whether a digital asset is regulated as a security by the SEC or as a digital commodity by the CFTC. A pathway to registration is also established by the CLARITY Act, providing digital asset intermediaries, including exchanges, with more straightforward licensing and compliance guidance.
