Biography

Nick Sullivan is an experienced trial attorney who guides clients through every state of the litigation process in both state and federal court.  He specializes in complex business and commercial disputes, trust and estate litigation, construction, and real estate.  Nick’s experience extends beyond the courtroom, encompassing mediation, arbitration, and negotiation.  Nick’s unwavering commitment to achieving favorable outcomes for his clients makes him a trusted legal advisor.  He is also a member of the Firm’s Recruiting Committee.

Representative Experience

Successfully represented County Board of Equalization before the Nebraska Tax Equalization and Review Commission and the Nebraska Supreme Court in affirming the Board’s valuation of agricultural real estate.  Cain v. Custer County Board of Equalization, 315 Neb. 809, 1 N.W.3d 512 (2024).

Obtained favorable jury verdict in week long jury trial involving undue influence claims over amendments to will and trust.  (2023).

Successfully argued on appeal before the Iowa Supreme Court that strict liability is a viable cause of action against municipalities under the Iowa Municipal Tort Claims Act.  Sutton v. Council Bluffs Water Works, 990 N.W.2d 795 (Iowa 2023).

Served as local counsel in two separate three week jury trials and on appeal in obtaining overall $2.4 million judgment in favor of client in breach of contract action related to bingo hall management software (2021).

Obtained judgment in favor of general contractor on its breach of contract and bad faith lien filing claims against subcontractor, and against subcontractor on its breach of contract, Prompt Pay Act, and unjust enrichment claims related to construction of two fast food restaurants (2020).
